Terms of Service

1. Agreement
By creating an account or using TapTax ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a legally binding agreement between you and TapTax. References to "you" mean the individual using the Service.
2. The Service
TapTax is a Making Tax Digital (MTD) compliance tool that helps UK sole traders and landlords track income and expenses, categorise transactions, and submit quarterly updates to HMRC. The Service is a tax filing assistant and does not constitute financial, legal, or tax advice. Always consult a qualified accountant for complex tax matters.
3. Eligibility and account
You must be 18 or over and resident in the United Kingdom to use the Service. You are responsible for:
- Keeping your account credentials secure and confidential.
- All activity that occurs under your account, whether authorised by you or not.
- Providing accurate and up-to-date information when registering and filing.
- Notifying us immediately at [email protected] if you suspect unauthorised access.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including tax evasion or fraud.
- Submit false or misleading information to HMRC via the Service.
- Attempt to reverse-engineer, scrape, or disrupt the Service or its underlying infrastructure.
- Share your account with others or use the Service on behalf of a third party without their express authorisation.
- Use automated means to access the Service without our prior written consent.
5. Subscriptions and payment
The Service is available on Free, Starter, and Pro plans. Paid plans are billed in advance on a monthly or annual basis:
- Payments are processed by Stripe and are subject to their terms. We never store your card details.
- Subscriptions renew automatically unless cancelled before the renewal date via your account settings.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
- If a payment fails, we will attempt to retry and may suspend your account after reasonable notice.
6. HMRC submissions
When you instruct TapTax to submit a quarterly update to HMRC, you confirm that the information is accurate and complete to the best of your knowledge. You remain personally responsible for the accuracy of all HMRC filings. TapTax acts as your agent for the purpose of digital submission only and does not accept liability for penalties arising from inaccurate data you have provided.
7. Intellectual property
All intellectual property rights in the Service, including software, design, content, and trademarks, are owned by or licensed to TapTax. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal tax compliance purposes. You retain ownership of all data you input into the Service.
8. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. Tax estimates displayed in the app are approximations based on the data you provide and should not be relied upon as definitive tax advice.
9. Limitation of liability
To the maximum extent permitted by law, TapTax's total liability to you for any claims arising out of or in connection with the Service shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including loss of profits, data, or business. Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10. Termination
You may close your account at any time. We may suspend or terminate your account if you breach these terms, with notice where reasonably practicable. On termination, your access to the Service ends immediately. We will retain your data as described in our Privacy Policy.
11. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to these terms
We may update these terms from time to time. We will notify you by email of material changes at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
